Privacy Policy

Last updated:  10/21/2026

Gain Servicing (“Gain,” “we,” “our,” or “us”) respects your privacy. This Privacy Policy explains how we collect, use, disclose and protect personal information when you visit gainservicing.com, use our platform and services, contact us, or ask us about pre-settlement funding for a personal injury case (“applicants”).

It also applies to funding requests made on cherokeefunding.com, the website of our affiliate Cherokee Funding, which our team reviews and services. Cherokee Funding’s own privacy policy also applies to that website.

1. Information we collect

Information you give us

  • Name, email address and phone number.
  • Organization or firm details, and account credentials for our platform.
  • Case-related information, including client or patient information, documents, invoices, medical records and communications that law firms, healthcare providers and other users upload to our platform.
  • Information you send us when you contact us, register for an event or ask us about our services.

If you request funding

Through our online funding request form, you, your attorney or another authorized person may give us:

  • your state, the type of case and whether you have an attorney;
  • your first and last name, mobile number and email address;
  • your attorney’s name, law firm and law firm phone number, if you have an attorney (an attorney who submits a request for a client also gives us their own name and email address);
  • when the accident happened (month, day and year), whether the case is still pending, and the amount you are asking for;
  • whether you already received funding from another company, and which one;
  • how you prefer to be contacted first (call or text); and
  • your consent choices: whether you agreed to receive text messages and, if you did, the words you agreed to, when you agreed, the page you were on and your IP address at that moment, and the privacy statement you accepted.

We save what you enter on the first screen as soon as you continue, even if you do not finish the form, so that our team can contact you about your request.

We may record and transcribe phone calls with our team, and summarize them with automated tools, to keep an accurate record of your request and for quality and training.

Please do not use the online form to send medical records, Social Security numbers, bank information or other sensitive documents. If more information is needed, our team will provide an appropriate way to send it.

Information collected automatically

When you use our website, we and our service providers collect:

  • device and browser information, IP address, approximate location based on the IP address, pages viewed, links clicked, how you scroll and move around a page, the website that referred you, and the dates and times of visits;
  • advertising information, such as campaign details in the page address (for example utm_source or utm_campaign) and the click identifiers advertising platforms add when you click an ad (for example Google’s gclid, gbraid or wbraid, and Meta’s fbclid). If you request funding, we keep these with your request so we know which ad or campaign brought you to us;
  • activity on our platform, such as case updates, uploads and interactions; and
  • information collected by cookies, pixels, tags and similar technologies, described in Section 5.

Information from others

We may receive information from:

  • law firms, healthcare providers and partners that use Gain;
  • your attorney or law firm, when they confirm representation or your claim;
  • our affiliate Cherokee Funding, when you request funding on cherokeefunding.com;
  • analytics and advertising partners, such as reports on how our ads and website perform;
  • visitor-identification services, which may tell us which business, and in some cases which person, visited our website (see Section 5); and
  • tools our customers connect to our platform, such as customer relationship management, electronic health record or practice management systems.

2. How we use information

We use personal information to:

  • provide, operate and maintain our platform and services, including case tracking, servicing workflows, collaboration between attorneys, healthcare providers and other stakeholders, and the notifications and updates that come with them;
  • receive and review funding requests, contact applicants and their attorneys, and confirm representation and claim information;
  • prepare, fund and service a funding transaction;
  • send the communications you requested or agreed to, including calls, emails and text messages if you opted in;
  • send confirmations, reminders and follow-ups when you register for a webinar or event, and tell you about similar events (you can opt out at any time);
  • reach out to law firms, healthcare providers and other businesses about our services;
  • understand how people use our website, forms and platform, and improve them;
  • measure and improve our advertising, including counting how many people who click an ad go on to request funding, and showing our ads to people who may be interested in them;
  • prevent fraud and abuse, and secure our website, platform and systems; and
  • comply with law, maintain business records, and establish or defend legal rights.

3. How we disclose information

We may disclose personal information to:

  • Gain’s affiliated companies, including Cherokee Funding, involved in reviewing, funding or servicing a request;
  • an applicant’s attorney or law firm, to confirm the claim and administer a transaction;
  • authorized users within your organization and the parties you work with on our platform, such as attorneys, healthcare providers and servicers;
  • service providers that host our website, form and platform, keep our customer and case records (for example HubSpot and Salesforce), deliver email, calls and text messages, and provide analytics, automation, security, fraud prevention and professional advice;
  • advertising, social media and visitor-identification providers, as described in Sections 5 and 6;
  • regulators, courts, law enforcement or other parties when disclosure is required or reasonably necessary to comply with law or to protect rights, property or safety; and
  • a buyer, successor or other party in a proposed or completed merger, financing, reorganization or transfer of business assets.

We do not sell the information you enter in our funding request form, and we do not give advertising platforms the answers you give in it. If you request funding after clicking one of our ads, we may tell that platform that the click led to a request, using the platform’s click identifier (such as Google’s gclid).

4. Calls and text messages

Submitting a mobile number authorizes us to contact you about your request. If you tick the optional text-message box on our funding request form, Gain Servicing may text you at the number you provided about your request. Consent to texts is not a condition of receiving funding. Message frequency varies. Message and data rates may apply. Reply STOP to stop texts and HELP for help, or call (877) 263-4633. You can also tell us on a call or email info@gainservicing.com, and we will act on your request within 10 business days.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information may be shared with subcontractors that support our services, such as message delivery and customer service. All other categories of disclosure in this policy exclude text-messaging originator opt-in data and consent; this information will not be shared with any third parties.

5. Cookies, pixels and similar technologies

We and our partners use cookies, pixels (small pieces of code), tags and similar technologies on our website to make it work, understand how visitors use it, measure and improve our advertising, and identify businesses that visit us. We manage several of them with Google Tag Manager.

These technologies collect information such as cookie and device identifiers, IP address, browser type, the pages you visit and how you interact with them, and, for some tools, information you submit in forms on our web pages. They do not receive what you type into our funding request form, which runs separately from the rest of the page. Third parties, including Google, Meta and LinkedIn, may use cookies, web beacons and other storage technologies to collect or receive information from our website and elsewhere on the internet, and use it to provide measurement services and target ads, under their own privacy policies.

The tools on our website are:

Provider

Tool

What it does

Google

Google Tag Manager

Loads and manages several of the tools below.

Google

Google Analytics

Measures visits, pages viewed and how visitors use our website.

Google

Google Ads tools (Conversion Linker and Google Ads tag)

Store the ad click identifier (such as gclid) so we can tell which ads lead to requests, and measure our Google ads.

HubSpot

HubSpot tracking code and forms

Records visits and connects them to your request or inquiry, and keeps what you send through our forms in our customer records. It can also load the Meta, LinkedIn and Google Ads tags when advertising cookies are allowed.

Meta

Meta Pixel

Measures and improves our Facebook and Instagram ads.

LinkedIn

LinkedIn Insight Tag

Measures visits and our LinkedIn advertising.

Microsoft

Microsoft Clarity

Records how visitors use our pages (clicks, scrolling and mouse movement) to create heatmaps and session replays.

Visitor-identification services (such as Vector)

Pixels

Identify businesses, and in some cases individuals, that visit our website, for our business outreach. Some can read information entered in forms on our web pages (not our funding request form).

Gain

Our funding request form (hosted on Vercel)

Collects what you enter (Section 1), your IP address, the page you applied from and the ad details in the page address. It loads fonts from Google Fonts, so Google receives your IP address when the form loads.

6. Advertising and your choices

Some state privacy laws treat letting advertising, social media and visitor-identification providers collect information through pixels on our website as a “sale” or “sharing” of personal information, or as “targeted advertising.” In that sense, we may sell or share online identifiers (such as cookie and device identifiers and IP address) and internet activity (such as pages viewed and interactions with our ads and website) with those providers. We do not sell or share the information you enter in our funding request form, and we do not knowingly sell or share the personal information of anyone under 16.

You can opt out at any time:

Opting out in a browser applies to that browser and device. Because there is no common standard for “Do Not Track” browser signals, we do not respond to them.

7. Your privacy rights

Depending on where you live, you may have the right to:

  • know or access the personal information we have about you, and receive a copy in a portable format;
  • correct inaccurate personal information;
  • delete personal information;
  • opt out of the sale or sharing of personal information and of targeted advertising (see Section 6);
  • withdraw consent you gave us, and object to or restrict some processing; and
  • not be treated differently for exercising these rights.

To make a request, email info@gainservicing.com or call (877) 263-4633. We will confirm that we received your request within 10 business days and respond within 45 days. If we need more time, we will tell you, and we may take up to 45 more days where the law allows. To protect you, we verify requests by matching the information you give us with what we hold. You may use an authorized agent; we may ask for your signed permission and ask you to confirm your identity directly with us. If we decline your request, we will explain why, and you may appeal by replying to our decision. If you are not satisfied with the result of your appeal, you may contact your state attorney general.

Some information may be exempt from these rights, for example information covered by federal financial privacy law, or information we must keep to complete a transaction, comply with law, detect fraud or establish legal rights. When we process case information on behalf of a law firm or healthcare provider, we may refer your request to them.

If you are in the European Economic Area or the United Kingdom, we process personal information to perform a contract with you, for our legitimate interests in running and securing our services, to comply with legal obligations, and with your consent where required (for example for marketing). You also have the right to data portability and to complain to your local data protection authority.

8. California residents

This section adds to the rest of this policy for California residents. In the last 12 months we collected these categories of personal information:

  • identifiers, such as name, email address, phone number, IP address, cookie and device identifiers and ad click identifiers;
  • customer records, such as name, address, phone number and account information;
  • legal claim and commercial information, such as case type, accident date, attorney representation, current funding, the amount requested, funding requests and their status, and services provided;
  • professional information, such as attorney, law firm or healthcare provider details;
  • internet or other electronic network activity, such as pages viewed and interactions with our website, ads and platform;
  • approximate location inferred from IP address;
  • audio and similar information: recordings, transcripts and summaries of phone calls with our team; and
  • sensitive personal information, such as health information contained in case records that law firms and healthcare providers share with us to use our services. We do not ask applicants to send sensitive information through our website.

We collect these categories from the sources in Section 1, and use and disclose them for the purposes in Sections 2 and 3. We sell or share only online identifiers and internet activity, only as described in Section 6, and you can opt out using any method there. We do not use or disclose sensitive personal information for purposes that would give you a right to limit its use under California law. We do not offer financial incentives for personal information. We keep each category for the periods in Section 10.

9. If you obtain funding

If you enter into a funding agreement, information we collect to provide that financial product or service may also be governed by federal financial privacy law and by any privacy notice we give you with your agreement. If that notice applies to information and differs from this policy, that notice controls for that information.

10. Security and retention

We use administrative, technical and physical safeguards designed to protect personal information, including encryption in transit and at rest, role-based access controls and system monitoring. No website or transmission method can be guaranteed completely secure.

We keep personal information only as long as reasonably necessary for the purposes in this policy:

  • funding request, claim and contact information: while we review your request and, if you obtain funding, for the life of the agreement and its servicing; then as long as needed to meet legal, regulatory and record-keeping duties, resolve disputes, prevent fraud and establish or defend legal rights;
  • platform and case information: as long as our agreement with the law firm or healthcare provider requires, and as needed to meet legal duties;
  • consent records, including text-message consent: for as long as we may contact you, and as long as needed to show consent under telephone and text-messaging laws;
  • call recordings, transcripts and summaries: as long as needed to keep an accurate record of your request and to meet our legal duties;
  • website, analytics and advertising data: for the period set in each tool, and in our customer records for as long as the related record is kept. Advertising platforms keep data under their own policies; and
  • records of privacy requests: at least 24 months.

11. Where we offer funding

Pre-settlement funding is not available everywhere. We currently do not provide funding in Arkansas, Colorado, the District of Columbia, Indiana, Kansas, Kentucky, Maryland, Minnesota, Nevada, North Carolina, Vermont, Virginia or West Virginia. Availability may change.

12. Children’s privacy

Our website and services are intended for adults 18 and older and are not directed to children. We do not knowingly collect personal information from children under 13 through our website, and we do not knowingly sell or share the personal information of anyone under 16.

13. Visitors outside the United States

Our services are intended for the United States. If you use them from elsewhere, your information will be transferred to and processed in the United States. Where the law requires, we use safeguards such as standard contractual clauses.

14. Links to other websites and social media

Our website and platform may link to third-party websites and services, including our social media pages. Their privacy practices are governed by their own notices, not this policy.

15. Changes to this policy

We may update this policy as our practices or legal obligations change. The “Last updated” date at the top shows when this version took effect. Material changes will be presented as required by law.
